IF A PERSON HAS ALLREADY FILLED AN OJT LOGBOOK BEFORE 12 JANUARY 2024 BUT HAS NOT COMPLETED THE REQUIRED AMOUNT OF TASKS HIS LOGBOOK ENTRIES BEFORE THAT DATE MAY BE IGNORED - Check with your NAA!!!
1. In accordance with Part-66 Appendix III, OJT must be conducted within an approved and controlled environment under an accepted programme. Once approved, such programme constitutes an ongoing training activity.
2. Commission Implementing Regulation (EU) 2023/989 does not include any provision requiring the invalidation or restart of already approved and ongoing OJT programmes.
3. In absence of explicit retroactive requirements, the principles of legal certainty and non-retroactivity apply; therefore, training activities lawfully initiated under previously accepted conditions remain valid until completion.
Can OJT programmes approved and started before the applicability date can be completed under the old rules?
